We write regarding your registration and use of the domain name instagram********.com, which contains the Instagram trademark.
As we are sure you know, Instagram is a popular photo sharing and social networking mobile application and service, which is also available at www.instagram.com. Instagram owns exclusive rights to the INSTAGRAM trademark, including rights secured through common law use and registration in the United States (Reg. Nos. 4,170,675 and 4,146,057) and elsewhere. Instagrams fame and recognition entitles it to broad legal protection.
As we hope you can understand, protection of its trademarks is important to Instagram. In fact, Instagram has an obligation to protect the value of its trademarks by enforcing against use of domain names that may cause consumer confusion or dilute the distinctiveness of its trademark.
While we respect your right of expression and your desire to conduct business on the Internet, we are concerned that your domain is likely to cause people to think that you are affiliated with Instagram, or endorsed by us. As you can imagine, various third parties around the world have attempted to wrongfully capitalize on Instagrams reputation by registering domain names that include or are derived from the INSTAGRAM brand.
We recognize that you may not have intended any harm, and you also may not be aware of the laws that apply to trademarks and domain names. Registration and use of domains can violate the Lanham Act (15 U.S.C. 1051 and the following sections) if they infringe or are likely to dilute a trademark. Infringement occurs when a third partys use of a companys trademark (or a confusingly similar variation thereof) is likely to confuse consumers as to the affiliation, sponsorship or endorsement of the third partys services. Trademark dilution occurs when a third partys use of a variation of a companys trademark is likely to lessen the distinctiveness of the companys famous trademark. Registration and use of a domain name containing anothers trademark can also violate the Anticybersquatting Consumer Protection Act, and may be subject to transfer under the Uniform Domain-Name Dispute-Resolution Policy.
To avoid confusion and harm to the Instagram brand, we must insist that you stop using instagram********.com and disable any site available at that address. You should not sell, offer to sell, or transfer the domain name to any third party.
