işbankasıyla olan domain davam için ayın 10'una kadar savunma yapmamı istemişlerdi ve savunmamı yaptım savunmam dahilinde bugun davanın başladığını gerekirse hem Türk hemde Yabancı hakem ayarlanacağı ile ilgili belge geldi bakalım sonuç ne olacaktır ingilizce savunmam aşşağıdaki gibidir bura yazmam yanlışsa belirtiniz kaldırayım

I got the domain named www.siteismi.com with the aim of providing mobile phone users with the games, themes, sounds and mobile phone problems so that people could negotiate about these problems. However Isbank has founded and started an application called "new program", and because they havent been able to contact me they felt the need to complain you about this subject.
They got the information of "who is?" from you as far as i am concerned, then they phoned me saying that if they had been able to contact me they wouldnt have made a complaint to you. the person i contacted Mr isim told me that they wanted to gain that domain. Since I now have a project under the mentioned name www.siteismi.com i wasn't willing to give that domain to them. then they told me that they didnt want to get this domain free of charge and they had an amount to pay the registration fee for the domain registration. i would like to stress that there is an understanding that the first person who posseses the domain names of com, net ,org buys these... also i would like to tell u that in my site there is nothing that belittles Isbank, insults or whatsoever, nevertheless their only aim is to have this name, what they told me is that they had never lost a court case about "wipo".
when we generally have a look at such cases, unless there is something that drcries the others, the copyright would remain with the first owner of the site.
I dont know how much chance i have against a billion-dollar company. furthermore, why would try to people buy the website at last resort before they start an application, it doesnt seem logical to me. if you should check their other websites they have "com.tr" appendage. i havent got the faintest idea about and dont understand how much they are obsessed with this name.
now that u have asked me to write a justification, this is all i can do for now..
the decision is your jury's to give...

p.s may i please ask you to regard Turkish as our communication language in which i can express myself best..,

arkadaşlar bir domain şuan ismini vermek ne kadar uygun olur bilmiyorum savunmam budur ingilizce anlayan arkadaşlar nasıl olduğuna dahil yorum yaparsa ona göre geliştirebilirim bugun 1-2 mail daha geldi

Allahın izniyle milliyet.net davasındaki gibi bende kalır domain görüşmeler içindeyim sizce sonuç ne olur milliyet diye bir şirket varken dava kazanılıyorsa bu şirket olmayan bir isimden kazanma oranım sizce nedir

Domaini alabileceklerini hiç sanmıyorum .com .net .org gibi uzantılarda ilk gelen alır mantığı var sonuçta. zaten banka adı filan da geçmiyomuş zor alırlar

ufak bir öneri yapmak istedim; eğer domain "cepanahtar.xxx" gibi bir domainse; hemen nöbetçi çilingir numaraları olan bir site yap derim, en azından ben bu proje için aldım dediğinde elinde somut bir kanıt olur
