Türkiyede fikri mülkiyetin korunması ile ilgili ulusal mevzuat
gereğince Fonogram yapımcıları, üzerinde hak sahibi bulundukları fonogramlarda
( kaset ve cd lerde ) bulunan icraların tespitlerinin telli veya telsiz
araçlarla satışı veya diğer biçimlerde umuma iletimine izin vermek veya
yasaklamak hakkına sahiptir.
İşte müvekkilimiz MÜ YAP Bağlantılı Hak Sahibi Fonogram Yapımcıları
Meslek Birliği de, üyeleri bulunan fonogram yapımcılarının bu haklarını
korumak ve takip etmek üzere kurulmuştur. MÜ YAP Meslek Birliği ile

incelemelerde, sitede müvekkil meslek birliğinin üyeleri fonogram
yapımcılarının üzerinde hak sahibi bulundukları fonogramlarda bulunan icraların
gerekli izinler almaksızın ve yasadışı bir şekilde mp3 ve benzer
formatlarda kullanıldığı ve umuma iletildiği belirlenmiştir.
Tüm bu sebeplerle, ilgili mevzuat hükümleri gereğince iş bu
e-mailimizin tarafınıza ulaşmasından itibaren 3 ( üç ) gün içerisinde sözü edilen
yasa dışı kullanımın ( ihlalin ) durdurulmasını, ihlale konu mp3 lerin
içerikten çıkarılmasını, aksi takdirde ise ulusal ve uluslar arası
mevzuattan kaynaklanan tüm başvuru ve şikayet haklarının kullanılacağını
ihtaren bildiririz.

In accordance with the national legislation related to the protection
of intellectual property in Turkey, Phonogram producers are authorized
for or to prohibit the sale of the fixations of the performances
through instruments whether by cable or over the air, the public distribution
of the performances present at the phonograms (cassette, CD) where
the phonogram producers have the rights on.
Here it is, the client, MÜ-YAP Bağlantılı Hak Sahibi Fonogram
Yapımcıları Meslek Birliği has been founded to protect and execute the rights of
the member phonogram producers. You may find the whole information

transmissed in public illegally without obtaining the necessary
permission, has been detected.
For these reasons, in accordance with the provisions of the relevant
legislation, within 3 (three) days begining from the passing of this
e-mail to you, do we ask you to put an end your illegal usage
(infiringement) and remove the MP3 files subject to the violation from the web-site
content otherwise we inform you by means of this notice that the
rights for application and complaint arising from the national &
