Türkiye'de fikri mülkiyetin korunması ile ilgili ulusal mevzuat gereğince Fonogram Yapımcıları, üzerinde hak sahibi bulundukları fonogramlarda ( kaset ve CD'lerde ) bulunan müzik tespitlerinin dijital iletim de dahil olmak üzere her türlü telli veya telsiz araçlarla satışı veya diğer biçimlerde umuma iletimine izin vermek veya yasaklamak hakkına sahiptir.


MÜ-YAP Bağlantılı Hak Sahibi Fonogram Yapımcıları Meslek Birliği, üyeleri bulunan fonogram yapımcılarının 5846 Sayılı Fikir ve Sanat Eserleri Kanununda tanımlanan mali haklarını korumak ve takip etmek üzere kurulmuş bir meslek birliğidir. MÜ - YAP Meslek Birliğinin koruması altında bulunan repertuar ve diğer hususlar ile ilgili tüm bilgileri resmi internet sitesi olan www.mu-yap.org ve T.C. Kültür ve Turizm Bakanlığının resmi Internet sitesi olan www.kultur.gov.tr den ulaşabilirsiniz.

http://www.radyo*******/isimli Internet sitesi ile ilgili olarak yaptığımız incelemelerde, sitede müvekkil meslek birliğinin haklarının ihlal edildiği ve koruması altındaki müzik yapıtlarının gerekli izinler almaksızın ve yasadışı bir şekilde radyo-televizyon yayınlarının eşzamanlı olarak internet sitesi aracılığıyla iletilmesi suretiyle bu radyo-televizyon yayınları içerisinde ve/veya mp3, video klip ve benzer formatlarda kullanıldığı, streaming de dahil on-line olarak dinletildiği, umuma iletildiği ve başkalarının erişimine imkan sağlandığı belirlenmiştir. Tüm bu sebeplerle, ilgili mevzuat hükümleri gereğince işbu e-mailimizin tarafınıza ulaşmasından itibaren 3 ( üç ) gün içerisinde;

• MÜ-YAP’ın koruması altındaki repertuar ile ilgili bilgilerin güncel olarak takip edilerek sözü edilen yasa dışı kullanımların (ihlallerin ) sona erdirilmesini,

• müvekkil MÜ-YAP Meslek Birliğinin koruması altında bulunan ve ihlale konu edilen www.mu-yap.org adresinde yer alan ve sürekli olarak güncellenen repertuarın tamamının (mp3lerin, video kliplerin) içerikten çıkarılmasını, yapılan radyo yayınının ve on-line yayınların durdurulmasını,

• aksi takdirde sitenize erişimin engellenmesi ve hakkınızda ceza ve hukuk davası açılması için ulusal ve uluslar arası mevzuattan kaynaklanan tüm başvuru ve şikayet haklarının kullanılacağını 5846 sayılı Fikir ve Sanat Eserleri Yasasının 71., 80. ve Ek 4. maddeleri gereğince ihtaren bildiririz.

Ekte, örnek olarak ihlali belirleyen ekran görüntüleri bulunmaktadır. Ancak, yapılmakta olan ihlal, sadece ekran görüntüsünde belirtilen müzik yapıtları ile sınırlı olmadığından MÜ-YAP Meslek Birliğinin koruması altında bulunan tüm repertuarın tarafınızca araştırılıp bulunarak yukarıda da belirtildiği üzere içerikten çıkarılması gerekmektedir. Aksi takdirde sitenizin erişime kapatılması da dahil hakkınızda her türlü yasal yola başvurulacağını bildiririz. 17/08/2018

To Whom Concern

In accordance with the national legislation related to the protection of intellectual property in Turkey, Phonogram producers have the exclusive right to authorize or prohibit the sale of the musical fixations recorded on phonograms (such as cassettes, CD etc) which the phonogram producers have the rights on by all sorts of wire or wireless means including digital transmission and the communication to the public by any other means.

"MÜ-YAP Related Rights Holder Phonogram Producers Colecting Society" is a collecting society that has been founded to protect and to execute the economic rights of the phonogram producers which is defined in the law number 5846 on The Intellectual and Artistic Works Law. You are able to get all information concerned with the repertoire under the protection of MÜ-YAP and other relevant subjects from official web-sites of MÜ-YAP titled as www.mu-yap.org and/or <http://www.mu-yap.org> and of the Ministry of Tourism and Culture titled as www.kultur.gov.tr and/or <http://www.kultur.gov.tr>.

While investigating the web-site having http://www.radyo*******/the name of it is detected that the economic rights of phonogram producers under protection of MU-YAP have been violated and musical fixations under protection of MU-YAP have been used as MP3, video clip and similar format, communicated to the public including streaming as well as on-line listening and made available to the public without obtaining the necessary permission.

For these reasons, in accordance with the provisions of the relevant legislation, within 3 (three) days beginning from the passing of this e-mail to you,

• The violation mentioned above paragraph must be ceased by taking consideration of the current changes occurred on the repertoire under protection of MU-YAP

• The all repertoire under protection of MU-YAP and subject to the aforesaid violation which can be accessed from the website titled as www.mu-yap.org and has been updating continuously must be either removed from the content of the website having the name of http:// http://www.radyo*******/or the insting or other type of on-line broadcasting of said repertoire must be ended.

• Otherwise, we inform you by means of this notice that the rights for application and complaint arising from the national & international legislation shall be executed by MÜ-YAP in compliance with the articles 71, 80 and Additional Article 4 of The Law On Intellectual and Artistic Work in number of 5846, so as to stop access to your website having name of and to bring a civil action and a criminal prosecution against you.

On the other hand as summarized above, since the violation has not been limited for only the fixations determined in the screenshot sent you as an attachment of this e-mail, the all repertoire under protection of MU-YAP must be removed from the content of your website by taking consideration of the repertoire which exists in www.mu-yap.org. Otherwise we kindly inform you that all legal steps shall be taken against you as well as stopping the access to the websites having name of http://www.radyo*******/17/08/2018
