Further to our Acknowledgment of Receipt of Complaint, please be advised of the following:

The registrant of the disputed domain name in the above referenced proceeding has been identified by the concerned Registrar, FBS Inc., as being different to the entity named in the Complaint as Respondent. The registrant information we have received from the Registrar is as follows:

Please be advised that this invitation is not being issued by the Center as a formal deficiency under the Rules for Uniform Domain Name Dispute Resolution Policy (Rules), and that (although the Center generally recommends such amendment, as indicated also at the end of this email) you are not being (formally) required as such by the Center to file an amendment to the Complaint (or an Amended Complaint) in light of the same in order to proceed with the Complaint as filed.

If you choose not to accept this invitation to file an amendment to the Complaint (or Amended Complaint), we would ask that you confirm your election to proceed with your Complaint without amendment by January 10, 2011, on the basis that any resultant (or related) issues of proper Respondent identity would in any case need to be considered at the discretion of the (to be) appointed panel in due course.

If you should choose to accept the invitation and file an amendment to the Complaint (or an Amended Complaint) in light of the provided information, we would ask that you do so by January 10, 2011.

If you so choose to amend the Complaint, with a view to notification of the Complaint and implementation of any Decision under the Policy and Rules, we suggest that any such amendment should at a minimum contain the additional information which has been provided by the Registrar (as provided above). While such amendment is commonly made by the simple addition of the newly identified registrant to the Complaint (i.e., in addition to the original named Respondent), any final determination as to the proper identity of the Respondent will be at the sole discretion of the Panel to be appointed in this case.

We note also that any such amendment may have consequences for mutual jurisdiction and communications, and that the corresponding mutual jurisdiction and communications paragraphs of the Complaint may need to be addressed in any such amendment to the Complaint. You may also consider amending the facts and arguments in the Complaint in light of the above. Any submission by you to the Center as a result of this notice must be signed and should be copied to the Respondent as named therein and the concerned Registrar.

Any such amendment to the Complaint (or Amended Complaint) shall be submitted to the Center electronically (e.g., by signed PDF using the email address: domain.disputes@wipo.int).

Any such submission should be made to the Center by January 10, 2011.

Should the Center not receive any such amendment (or alternately, your confirmation that you elect not to file an amendment) by January 10, 2011, we will proceed to formal Complaint Notification on the assumption that you chose not to make an amendment to the Complaint in light of this notice. For avoidance of doubt regarding the Center's notification obligations under the Policy and Rules and to preserve the Panel's discretion (on appointment) to consider any Respondent identity issues, the Center will nevertheless provide a copy of the Complaint both to the Respondent as currently named in the Complaint, and to the registrant contact details subsequently disclosed by the Registrar.

To the extent that the Center's recommendation would be sought in this regard, it would be (if only to avoid potential decision implementation issues) to amend the Complaint in light of the disclosed information. While the decision to amend (or not) is at the discretion of the Complainant at this stage of the proceedings, we would note that it is also within an appointed Panel's discretion to require such amendment (and/or further procedural steps) at a later stage, or to take such other steps (including at the level of any issued decision as it may consider appropriate in light of any determination it may make regarding proper Respondent identity.

Dear Sirs,

The Complaint has been submitted in English. Pursuant to the Rules, Paragraph 11, in the absence of an agreement between the parties, or specified otherwise in the registration agreement, the language of the administrative proceeding shall be the language of the registration agreement, subject to the authority of the Administrative Panel (once appointed) to determine otherwise.

According to information we have received from the concerned registrar, the language of the registration agreement for the disputed domain name is Turkish.

Instructions to the Complainant

Accordingly, the Complainant is requested to provide at least one of the following:

1) satisfactory evidence of an agreement between the Complainant and the Respondent to the effect that the proceedings should be in English; or

2) submit the Complaint translated into Turkish; or

(In this connection, please note that the Center makes available a model Complaint in Korean, Spanish, Portuguese, Japanese, French and English on the Center's website at www.wipo.int/amc. The model Complaint is available at http://www.wipo.int/amc/en/docs/complaint-eudrp.doc, with other language options available in the upper right-hand side of the webpage.)

3) submit a request for English to be the language of the administrative proceedings. Such request shall include arguments and supporting material (to the extent not already provided in the Complaint) as to why the proceedings should be conducted in English.

Such considerations may include for example the language used in pre-Complaint correspondence between the parties, the identity of the parties, the nationality and place of residence of the parties, and any other evidence of familiarity with the requested language. Should the Complainant already have submitted such request in its Complaint, it is requested to confirm that it has nothing further to add to it.

Please note however, that should the Complainant decide to pursue the latter option (3), neither the Center nor the Administrative Panel will be precluded from requiring, on its own or in light of submissions that may be received from the Respondent on this issue, that the proceedings take place in the language of the registration agreement and requesting that all documentation in the proceedings not in that language be translated into Turkish.

Should the Complainant fail to provide the Center by January 8, 2011 with at least one of the above-referred three options, the Complaint may subsequently be deemed withdrawn, without prejudice to the submission of a new Complaint by the Complainant.

Any submission by the Complainant to the Center in reply to this notification, must be copied to the Respondent in accordance with the Rules, Paragraph 2(b) and 2(h). Such communication shall be submitted electronically to the Center by email to domain.disputes@wipo.int.

Instructions to the Respondent

In all cases, if the Respondent is intending to participate in these proceedings, and/or has any comments on the Complainant's submission replying to this notification, the Respondent is requested to submit these to the Center by January 10, 2011.

Specifically in the case of the Complainant submitting (or indicating that it will submit) a request for the language of proceedings to be English, and the Respondent objects to such request, the Respondent is invited to indicate that objection for the record, and to submit any arguments/supporting materials (in light of the considerations enumerated in paragraph 3) above) as to why the proceedings should not be conducted in English.

Please note that if we do not hear from you by this date, we will proceed on the basis that you have no objection to the Complainant's request that English be the language of proceedings.

Any submission by the Respondent to the Center that is required as a result of this notification, must be copied to the Complainant in accordance with the Rules, Paragraph 2(b) and 2(h). Such communication shall be submitted electronically to the Center by email to domain.disputes@wipo.int.

Şikayet İngilizce dilinde ibraz edilmiştir. Kurallar’ın 11. maddesi uyarınca idari işlem dili, taraflar arasında anlaşma bulunmaması ya da tescil sözleşmesinde aksi yönde düzenlenmemesi halinde, İdari Hakem Heyeti tarafından (atandığında) başkaca tayin edilebilmek kaydıyla, tescil sözleşmesinin diliyle aynı dil olacaktır.

İlgili tescil edenden aldığımız bilgiye göre, ihtilaflı alan ad(lar)ına ilişkin tescil sözleşmesinin dili Turkish.

Şikayet Eden’e Talimatlar

Buna göre, Şikayet Eden’den aşağıdakilerden en az birini temin etmesi talep edilmektedir:

1. Şikayet Eden ve Şikayet Edilen arasında, işlemlerin İngilizce olarak yürütüleceği yönünde anlaşma bulunduğunu gösteren yeterli delil; veya

2. Şikayet’in Turkish’ye tercüme edilmiş bir nüshasının sunulması; veya

(Bu bağlamda, Merkez’e ait http://www.wipo.int/amc adresindeki web sitesinde Korece, İspanyolca, Portekizce, Japonca, Fransızca ve İngilizce dillerinde düzenlenmiş örnek Şikayet mevcuttur. Örnek Şikayet’e, web sayfasının sağ üst köşesinde diğer dil seçenekleriyle birlikte http://www.wipo.int/amc/en/docs/complaint-udrp.doc adresinden ulaşılabilir.)

3. İngilizce nin idari işlem dili olması için talepte bulunulması. Söz konusu talebin, işlemin hangi sebeplerle İngilizce dilinde yürütülmesi gerektiğini gösteren gerekçeleri ve destekleyici materyalleri (halihazırda Şikayet kapsamında sunulmadığı ölçüde) ihtiva etmesi gerekmektedir.

Sözkonusu gerekçeler, örnek olarak, tarafların Şikayet öncesindeki aşamada aralarında yaptıkları yazışmalarda kullandıkları dil, taraflara ait kimlik, tabiiyet ve ikametgâh bilgileri ve talep edilen dile yakınlık hususuna dair diğer herhangi bir kanıtı içerebilir. Şikayet Eden’in böyle bir talebi halihazırda Şikayeti’nde belirtmiş olması halinde, ekleyecek başka bir husus bulunmadığını teyit etmesi rica edilmektedir.

Bununla birlikte, Şikayet Eden tarafından diğer (3). seçenek tercih edilmiş olsa dahi, Merkez ya da İdari Hakem Heyeti’nin, kendi takdirleri veya konuya ilişkin olarak Şikayet Edilen tarafından ibraz edilecek belgeler doğrultusunda, idari işlemin tescil sözleşmesinin dili üzerinden yürütülmesi ve söz konusu dilde olmayan tüm belgelerin Turkish tercümesini talep etme hakları saklıdır.

Şikayet Eden January 8, 2011 gün içinde yukarıda belirtilen üç seçenekten en az birini Merkez’e bildirmediği takdirde, Şikayet Eden tarafından yeni Şikayet sunulması hakkına halel gelmemek kaydıyla, Şikayet takiben geri alınmış sayılacaktır.

Şikayet Eden’in işbu bildirime cevaben Merkez’e sunacağı her türlü yazışmanın birer nüshası, Kurallar’ın 2(b) ve 2(h) no’lu maddeleri uyarınca Şikayet Edilen’e de kopyalanacaktır. Söz konusu yazışmalar, Merkez’e ait domain.disputes@wipo.int adresine e-postayla elektronik olarak gönderilecektir.

Şikayet Edilen’e Talimatlar

Tüm davalarda Şikayet Edilen’in, bu işlemlere katılmak istemesi ve/veya Şikayet Eden’in işbu bildirime cevaben gönderdiği beyana karşı herhangi bir görüşü olması halinde, söz konusu görüşlerini Merkez’e January 10, 2011 gün içinde göndermesi gerekmektedir.

Özellikle Şikayet Eden tarafından idari işlemin İngilizce dilinde yapılması için talepte bulunulması (veya bulunacağının belirtilmesi)i ve Şikayet Edilen’in söz konusu talebe itiraz etmesi halinde, Şikayet Edilen’in kayıt için itirazını belirtmesi ve işlemin hangi sebeplerle İngilizce dilinde yürütülmemesi gerektiğini gösteren gerekçeleri ve destekleyici materyalleri (yukarıda 3. fıkrada belirtilen hususlar ışığında) sunması gerekmektedir.

Söz konusu tarihe kadar tarafımıza beyanda bulunmamanız halinde, Şikayet Eden’in idari işlemin İngilizce dilinde yürütülmesi yönündeki talebine hiçbir itirazınızın bulunmadığından hareketle işlemlere devam edeceğiz.

İşbu bildirim sebebiyle Şikayet Edilen tarafından Merkez’e yapılacak her türlü bildirimin birer nüshası, Kurallar’ın 2(b) ve 2(h) no’lu maddeleri uyarınca Şikayet Eden’e de kopyalanacaktır. Söz konusu yazışmalar, Merkez’e ait domain.disputes@wipo.int adresine e-postayla elektronik olarak gönderilecektir.
